Learned counsel representing the Appellant, after arguing for some time and upon realizing that the Court is not inclined to admit the Appeal, prays for permission to withdraw the Appeal. 2.

It is be noted that the Commercial Court has passed a decree for recovery of amount to the extent of Rs. 2,58,683/-, as admitted by the Appellant in his written statement. Hence, there is no substance in the Appeal.

Moreover, the Plaintiff has filed an Appeal which absolutely has no merit. Hence, as prayed by learned counsel representing the Appellant, the present Appeal is dismissed as withdrawn. All pending applications are also closed.
