The present petition in the usual course is listed on 08.08.2025. However, an application being CM No.35545/2025, preferred on behalf of the petitioner, has been listed today seeking a direction that present petition be treated as representation to the respondent/CBSE, with further direction to the CBSE to dispose of the same.

With the consent of learned counsel for the parties, the writ petition is taken up today for consideration.

The present petition has been filed on behalf of the petitioner seeking following relief:
"A.
Pass a writ of Certiorari or any other appropriate writ and/or directions quashing the Impugned Order bearing no.CBSE/AFF./2730493/2024/01626 dated 05.11.2024 passed by the Respondent Central Board of Secondary Education (CBSE) as being completely illegal, arbitrary, unconstitutional and in violation of principles of natural justice."

the petitioner submits that the petitioner will not press the present petition any further if the respondent/CBSE treats the present petition as a representation and dispose of the same by a speaking order after affording personal hearing to the petitioner.

Having regard to the limited relief articulated by Mr. Singh, this Court deems it appropriate to dispose of the present petition with a direction to the respondent/CBSE to treat the same as representation and dispose of the same by way of a speaking order within a period of 10 days from today, after affording personal hearing to the petitioner. Ordered accordingly. 6.
It is made clear that petitioner school will not take any new admissions for Class-IX to Class-XII till the disposal of its representation. 7.
It is further clarified that nothing has been expressed on the merits of the case nor the present order will create any special equities in favour of the present petitioner.

The respondent/CBSE will be at liberty to seek any further documents from the petitioner school, if deemed necessary, for deciding the aforesaid representation.

The petition is disposed of in the aforesaid terms. Consequently, the pending applications also stand disposed of.

The next date fixed in the petition i.e. 08.08.2025 stands cancelled. 11.
