The petitioner has filed this petition under Article 226 of the Constitution, for a direction upon the respondents to release his vehicle bearing registration No. UP07F1041. The said vehicle was seized on 22.10.2024 on the ground that it is a petrol vehicle of more than fifteen years of age and is therefore an "End-of-life vehicle" under the Motor Vehicles (Registration and Functions of Vehicle Scrapping Facility) Rules, 2021.

Mr. Raghuvendra Upadhay, learned counsel for the respondents, states that he has been instructed that the vehicle, having been seized on 22.10.2024, and the petitioner not having filed an application for release thereof within the time stipulated under the Guidelines for Handling End of Life Vehicles in Public Places of Delhi, 2024 dated 20.02.2024 ["the W.P.(C) 17794/2024 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Mr. Kumar Amit, learned counsel for the petitioner, disputes the aforesaid contentions. He submits that an application for release of the vehicle was, in fact, made within time and the scrapping of the vehicle is de hors the Policy.

Be that as it may, it is evident that the relief sought by the petitioner in this writ petition has been rendered infructuous. Mr. Kumar Amit, therefore, seeks permission to withdraw the writ petition with liberty to institute appropriate proceedings for damages, if the petitioner is so advised.

The petition is dismissed as withdrawn with liberty as aforesaid.
