The present petition has been filed by the petitioner challenging the Order dated 12.11.2024 passed by the Commandant, 153 Battalion, Border Security Force (BSF), rejecting his representation. 2.

The learned counsel for the respondents, who appears on advance notice of this petition, states that the Impugned Order itself records that the statutory petition under Rule 28A of the BSF Rules is pending disposal before the competent authority at the FHQ, BSF and shall be disposed of soon. He submits that the petitioner has wrongly considered the impugned order as an order passed under Rule 28A of the BSF Rules.

14459/2024 filed by the petitioner herein, while disposing of the said said petition, granted liberty to the petitioner to avail of his remedies in accordance with law and for the said statutory petition to be decided by the respondents within eight weeks. The statutory petition of the petitioner, as stated by the respondents, is yet to be decided. The present petition is, therefore, premature in nature. 4.

We direct the respondents to comply with our Order dated 18.10.2024 and take a final decision on the statutory petition filed by the petitioner, latest within a period of three weeks from today, which is the time requested for by the learned counsel for the respondents. 5.

We reiterate that, in case, the final decision of the respondents is against the interest of the petitioner, it shall be open to the petitioner to challenge the same in accordance with law. 6.

The petition is, accordingly, disposed of.
