Petition under Section 482 of the Code of Criminal Procedure, 1973 (hereinafter referred to as 'Cr.PC')/Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.') has been filed on behalf of the Petitioners, for quashing of E-FIR No. 159/2016 dated 17.07.2016 under Section 354/354B/323/341/506/34 of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC') registered at Police Station Inderpuri, Distgrict West and all the consequential proceedings emanating therefrom, in terms of the Settlement dated 27.11.2025. 4.

The Complainant is present in person, who submits that on the date of incident, she was forcibly put in the van by some person and taken away and later, she has no clue of how she got recovered but her husband came to the Police Station. It is furether submitted that she is now not aware of the identitity of the persons, who had taken her in the van. 7.
On the Complaint of the Respondent No.2/Complainant, E-FIR No.159/2016 dated 17.07.2016 under Section 354/354B/323/341/506/34 of IPC, got registered at Police Station Inderpuri, Distgrict West. 8.
It is stated that the Petitioners and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement vide Memorandum of Settlement (MOU) dated 27.11.2025. 9.
The parties are present before this Court in-person today, and have been identified by their Counsel and Investigating Officer concerned and they have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement. 10.
It is a case of 2016 in which the Prosecution evidence is on going and considering the gravity of the offence, no quashing of E-FIR No.159/2016 dated 17.07.2016 under Section 354/354B/323/341/506/34 of IPC, registered at Police Station Inderpuri, Distgrict West, can be permitted on the basis of the Settlement.
