First Interim Bail Application under Section 439 Cr.P.C./483 B.N.S.S. has been filed on behalf of the Applicant-Varun Arora for a period of 30 days on account of ill health of the Applicant, in case FIR No.60/2021 under Section 302/328/419/284/34 IPC registered at P.S. Inder Puri, Delhi. 2.

Learned APP for the State has referred the medical health Status Report dated 10.12.2025 to highlight that the appropriate measures have been taken and as per the review conducted on 10.09.2025 in Neurosurgery, AIIMS Hospital, it was mentioned that a walker must be provided for ambulation and the patient be given bed rest and must avoid exertion, aggressive and heavy activities and to review after 03 months. It is further reported that the Petitioner had refused to get his surgery done while in Jail. 3.

crime of three murders and two attempted murders of the entire family by the Applicant who is the son-in-law. Only father-in-law has survived. Furthermore, reference is made to the order of the learned ASJ dated 29.05.2025 wherein it was noted that the physical condition of the Accused who was present in the Court and the medical record did not reflect any life threatening disease. The Interim Bail is accordingly opposed. Submissions heard and record perused.

As per the medical health status report, the Petitioner has been regularly taken to AIIMS Hospital for his treatment. As per the report, the next review is scheduled after 03 months. There is proper medication and treatment being provided by the Central Jail Hospital and the AIIMS Hospital.

Considering the medical condition and the report, no case is made out for grant of Interim Bail. However, the Jail Hospital shall ensure the appropriate treatment to the Petitioner and may also take him for review to AIIMS Hospital as and when required.

On the request of the Petitioner, it is hereby directed that the Jail Authority shall make the medical treatment record available to the Petitioner.
