This writ petition has been preferred on behalf of the Petitioner laying a challenge to the chargesheet dated 24.09.2024 as well as letter dated 23.10.2024 issued by Respondent No. 1 vide which Inquiry Officer was appointed and inquiry commenced.

After canvassing some arguments, learned counsel appearing on behalf of the Petitioner, on instructions, seeks to withdraw this writ petition with liberty to raise all issues, factual and legal, at the appropriate stage before the Inquiry Officer and subsequently if required. submitted that the prime reason for the Petitioner being on leave was his ill health for which he was also hospitalised and therefore a direction be issued to the Inquiry Officer to defer the proceedings to any date after 31.01.2025 since the Petitioner is on his way to recovery and will not be in a position to join the proceedings immediately.

Accordingly, this writ petition is disposed of as withdrawn with liberty to the Petitioner to raise all issues and contentions raised in this writ petition challenging the chargesheet as well as further inquiry proceedings pursuant thereto, during the inquiry proceedings and subsequent thereto. Without entering into the merits of the medical condition of the Petitioner, a direction is issued to Respondent No. 1 to ensure that inquiry proceedings are deferred beyond 31.01.2025, recording the assurance and undertaking of the Petitioner that he will join the proceedings on the dates fixed by the Inquiry Officer thereafter.
