Learned ASC for the State accepts notice.

By this petition, the petitioner seeks parole and also challenges the communication dated 31st October, 2017 whereby his application seeking parole on the ground that he has to engage senior counsel for filing the SLP before the Hon'ble Supreme Court, to arrange funds for the same and maintain social ties was dismissed.

Status report has been handed over which is taken on record. As per the status report verification was done of the residential address of the petitioner that is H. No. C-307, Gali No. 16, Old Mustafabad, Delhi where the father of the petitioner, namely, Jamshed met the Investigating Officer. Jamshed father of the petitioner informed that he was residing at the given W.P.(CRL) 977/2018

address with his wife and family of son Khalid aged 35 years. According to the father of the petitioner, the petitioner is unmarried and if he released on parole there is an apprehension that he may create more problems for family and neighbours. Considering the statement of father of the petitioner and the fact that in such a situation there is no issue of maintaining social ties with the family and that the SLP can also be preferred through legal aid from the Jail, this Court finds no ground to grant parole to the petitioner.

Petition is dismissed.

Copy of the order be communicated to the petitioner though Superintendent, Tihar Jail.
