Petitioners/judgment debtors have assailed order dated 12.11.2025 of the learned execution court, whereby their objections were rejected and warrants of possession of the subject property were issued and the petitioners were directed to show cause as to why they be not committed to civil imprisonment for having violated the permanent injunction order not to enter or visit the subject property.

There is no infirmity in the impugned order. After addressing partly, learned counsel for petitioners, on instructions of his clients present in the courtroom, seeks permission to withdraw this petition with liberty to stay in the subject premises for a period of only two months from today and also undertakes that the petitioners shall appear before the learned execution court as regards the show cause notice for civil imprisonment. Under these circumstances, the petition and the accompanying applications are dismissed as withdrawn with the directions that the petitioners shall appear before the execution court on 09.01.2026 to show cause against civil imprisonment and that on or before 07.02.2026, the petitioners shall hand over vacant physical possession of the subject property to the respondent/decree holder, Smt. Anjana Bansal and till that date, warrants of possession shall not be executed. But it is made clear that if on 09.01.2026 the petitioners do not appear before the execution court and/or do not vacate the subject property on or before 07.02.2026, the warrants of possession shall be executed expeditiously without any further indulgence.
