By this petition, the petitioner seeks bail in case FIR No. 266/2017 under Sections 376/506/34 IPC registered at PS Nangloi. 2.

Allegations against the petitioner who used to reside with her husband and children as a co-tenant on first floor with prosecutrix are that the petitioner pushed the prosecutrix, who fell on Vijay who whereafter committed rape on her. Though the complainant alleged that the petitioner and Vijay had prepared a video clipping and threatened to kill her husband and children, however, no such video clipping has been recovered during the course of investigation. Further, this fact was not mentioned by her in the first complaint to the police.

The role of the petitioner being of an abettor, the petitioner being in custody since 22nd August, 2017 and the prosecutrix having been already BAIL APPLN. 721/2018

examined, this court deems it fit to grant bail to the petitioner. 4.

It is, therefore, directed that the petitioner be released on bail on her furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount, subject to the satisfaction of the learned Trial Court, further subject to the condition that the petitioner will not leave the country without prior permission of the Court concerned and in case of change of residential address the same will be intimated to the Court concerned by way of an affidavit.
