I.A. 34751/2024 (Application filed under Order XXIII Rule 3 read with Section 151 of the CPC) 1.
This is a joint application on behalf of the plaintiff and the defendant seeking a consent decree based on the terms of the settlement as enumerated in paragraph No.4 of the present application, which are reproduced hereunder:
""From the date of the settlement, Gillette India Ltd will not depict a pink and/or white coloured spatula, and/or a pink and/or white coloured tube of hair removal cream in its advertisements of any kind published in India and/or any spatula in a shape similar to that of Reckitt Benckiser India Pvt. Ltd. spatula in relation to its product VEET, AND Reckitt Benckiser (India) Pvt Ltd will not depict a pink or blue coloured shaving razor in their advertisements of any kind published in India.""

The present application is duly supported by affidavits of the authorized representatives of the parties.

of the settlement and identify the signatures of their respective clients and pray that the suit be decreed in terms of the settlement, as reproduced hereinabove.

This Court has perused the aforesaid terms of settlement as recorded inter se the parties and finds them to be lawful. 5.
The parties shall remain bound by the aforesaid terms of settlement.

In view thereof, the present application is allowed and disposed of. CS(COMM) 246/2016 7.
The learned counsel appearing for the plaintiff, in view of the aforesaid settlement entered inter se the parties, prays that since the disputes between the parties have been amicably settled, therefore, the present suit be decreed on the terms thereof. 8.
Accordingly, the present suit is decreed in terms of the settlement recorded hereinabove.

Decree sheet be drawn up accordingly.
