Mr. D.J. Khera, who appears on behalf of the respondent/company as its authorised officer, states that he may be granted time to re-examine the issue with regard to the difference in the amount payable, as per the appellant vis-a-vis the respondent.

At the request of Mr. Khera, renotify on 20.04.2017. 3.

In the meantime, a cheque bearing No.484287 dated 08.03.2017 drawn in favour of the appellant for a sum of Rs.2,62,542/-, brought by Mr.Khera is handed over to the counsel for the appellant. There is an endorsement on the back of the cheque that it is full and final payment in RFA 270/2015.

Having regard to the stand taken by the counsel for the appellant that the said cheque is short by Rs.42,823/-, acceptance and encashment of the said cheque by the appellant shall not be treated as full and final payment. HIMA KOHLI, J MARCH 10, 2017 rkb RFA 270/2015
