% 08.04.2019 CM No.16439/2019 By way of this application, it is submitted by the Union of India that the rationale for agitating these proceedings - which challenged the order of the Central Administrative Tribunal in O.A.No.1864/2006, has ceased to exist. The relevant averment is as follows :

"6.

That the above Writ Petition 5689/2007 was filed against the Hon'ble CAT order in O.A. No. 1864/2006 which set aside the Respondent's (in O.A.) instructions granting the ACP benefits in non-functional scale to the applicant in the O.A. With the passage of time, Govt. instructions changed on the subject (Annexure C.M.A.-l) and came in consonance with the judgment given by Hon'ble CAT, in O.A. No.1864/2006. Therefore, the present Writ Petition has

become infructuous."

In the light of the above development, this court is of the opinion that nothing survives for consideration in the present matter. This writ petition is accordingly dismissed as infructuous. All pending applications also stand dismissed.
