Applicant seeks regular bail in FIR No. 112/2024 dated 27.11.2024, for commission of offences under Section 123/305(c)/3(5) of Bharatiya Nyaya Sanhita (BNS), 2023 (corresponding section 328/380/34 of IPC) registered at P.S. New Delhi Railway Station.

He is in custody since 26.10.2024.

It was apprised on the last date that the daughter of the petitioner is getting married and, therefore, the prosecution was directed to verify the same. 4.
Verification report has been received and, as per the Verification Report submitted by the prosecution, the factum of marriage of the daughter of the petitioner, scheduled for 08.02.2026, has been confirmed. 5.
Learned counsel for the applicant submits that the present application be treated as an 'interim bail application' so that applicant can come out from jail to take care of the abovesaid wedding of his daughter. She also submits that, simultaneously, liberty may be granted to the applicant to file application BAIL APPLN. 4727/2025 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. seeking regular bail afresh. She undertakes that as and when she files such application, she would also submit an affidavit, specifying therein with respect to all previous involvements of the applicant, with details and outcome thereof. 6.
The present case is already at the stage of prosecution evidence. 7.
Keeping in mind the overall facts and circumstances of the case and, in particular, the fact that marriage of daughter of the applicant is scheduled for 08.02.2026, the interim bail is granted to the petitioner for a period of four weeks, on his furnishing personal bond in a sum of Rs. 25,000/- with one surety of like amount subject to the satisfaction of learned Trial Court/CMM/Duty Magistrate. The period would be reckoned from the date he is released from the jail.

During such period, the applicant would not come in contact with the complainant or any public witness, in any manner, whatsoever, directly or indirectly.

The next date before the learned Trial Court is stated to be 09.02.2026 but in view of the abovesaid marriage, the applicant would be permitted to seek exemption from personal appearance through counsel and would move appropriate application in this regard before the learned Trial Court. 10.
The present application is, accordingly, disposed of. Liberty, as prayed, is granted.

A copy of this Order be immediately sent to the learned Trial Court and Jail Superintendent for information and necessary compliance. 12.
