The accused/applicant seeks regular bail in case FIR No. 615/2025 of PS Samaypur Badli for offence under Section 64(1) of BNS and Section 6 of POCSO Act.

Learned APP at the outset submits that at the time of the alleged occurrence, the prosecutrix was aged only 17 years and that it is a case of exploitative sexual assault in view of the age gap of almost 30 years between the prosecutrix and the accused/applicant. It is further submitted by learned APP that the accused/applicant is already married and has six children. 3.

Learned counsel for accused/applicant, on instructions, seeks permission to withdraw this bail application with liberty to file fresh application before the trial court after testimony of prosecutrix is recorded. 4.

As requested, the bail application is dismissed as withdrawn with liberty as sought. Accompanying application also stands disposed of.
