Petitioner has assailed order dated 23.01.2025 of the learned Additional Rent Controller, whereby his application under Order I Rule 10 CPC was dismissed. Broadly speaking, the petitioner claiming herself to be the actual owner of the subject property sought her impleadment in the eviction petition filed by the present respondent no.1 against the present respondent no.2. The learned trial court while dismissing the application took a view that impleadment of the present petitioner would widen the scope of the lis and further, the petitioner has already filed a civil suit impleading both respondents and has claimed cancellation of Sale Deed on the basis whereof respondent no.1 claims title over the subject property. 2.
After addressing partly, learned counsel for petitioner on instructions seeks permission to withdraw this petition.

The petition and the accompanying application are dismissed as withdrawn.
