The present petition under Section 12 read with Section 2(b) of the Contempt of Courts Act, 1971 seeks the following prayers: - "

It is therefore respectfully prayed to this Hon'ble Court that the contempt proceedings may kindly be initiated against the respondents and they be punished according to law for violating the order dated 26.3.2025 passed by the Hon'ble High Court of Delhi at New Delhi WP 3749/2025, titled as, "Sh. Virender Kumar Dua Vs. MCD & Ors.", in the interest of justice.

Any other relief which this Hon'ble Court deems fit and proper may also be passed in favour of the petitioner and against the respondents."

The present petition has been filed alleging wilful disobedience of an order dated 26.03.2025 passed in W.P.(C) 3749/2025 and in particular to the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. following directions: - "13. It is further directed that some senior official from the MCD shall appear and attend the hearing before the learned ATMCD, to ensure that effective submissions are made on behalf of the MCD, before the learned ATMCD."

Learned counsel appearing on behalf of the petitioner has placed on record certain order sheets reflecting that none had appeared on behalf of the MCD before the learned ATMCD in A. no. 539/23. 6.

Per contra, learned counsel for the MCD appearing on advance notice handed up in the Court today an order dated 15.04.2025 in the aforesaid proceedings, wherein it has been clearly mentioned that Mr. Vijay Meena, Asstt. Engineer (B). Keshav Puram Zone, had appeared before the learned ATMCD and had given his statement on record.

Learned counsel appearing on behalf the MCD further submits that as and when learned ATMCD requires the presence of the concerned Officer, he shall appear again.

The aforesaid order dated 15.04.2025 which shows compliance of the order dated 26.03.2025 in W.P.(C) 3749/2025, has not been placed on record by the petitioner. In these circumstances, this Court is of the considered opinion that the present petition has no merits. The same is dismissed and disposed of.
