Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner for quashing of FIR No.0143/2023 under Section 188 IPC, registered at PS: Shalimar Bagh, Delhi and all consequential proceedings emanating therefrom. 2.
Learned APP for the State appeasers on advance Notice. 3.
It is submitted in the Petition that FIR and Chargesheet already stands filed, on which the cognizance has been taken and Notice has been issued against the Petitioner on 07.12.2023. Application under Section 227 Cr.P.C. was filed, which was dismissed by learned MM on 22.04.2024. It is claimed that FIR and all consequential proceedings emanating therefrom be quashed. 4.
Pertinently, as per the submissions made in the Petition itself, Application for discharge of the Petitioner has already been dismissed by learned MM vide Order dated 22.04.2024 and instead of challenging this Order, Petitioner has chosen to file present Petition on 02.09.2025, i.e. almost after 1.5 year, for quashing of FIR.
