The petitioner, who is the complainant in FIR No. 141/2025, dated 10.03.2025, registered at P.S.
Prem Nagar under Sections 115(2)/126(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023, has filed this petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, for the following reliefs:
"a. Set aside the impugned order dated 06.09.2025 passed by the Ld. ASJ (Electricity), Rohini Courts, Delhi, in Bail Regn. No. 1752/2025; b. Cancel the police bail granted to the accused persons, namely Dayashankar, Rohan, and Rahul, in connection with FIR No. 141/2025, P.S. Prem Nagar, under Section 483(3) read with Section 528 BNSS, who are directly and indirectly threatening the complainant to be killed in case he does not withdraw the case or desist from pursuing the same;
c. Direct transfer of investigation to an independent and competent officer, not connected with the earlier tainted investigation, to ensure a fair and impartial probe which is right of a victim under article 21 of the Constitution of India;
d. Direct initiation of departmental and disciplinary proceedings against IO HC Om Prakash for collusion, destruction of evidence, and intimidation of the Petitioner;"

After some arguments, Mr. Bharat Dubey, learned counsel for the petitioner, seeks permission to withdraw this petition, without prejudice to the petitioner's right to approach the concerned authorities in the event of any threat or intimidation at the hands of the accused or their associates.

In the event such a complaint is made, the concerned DCP and SHO, are requested to ensure that it is looked into, and appropriate action, if necessary, is taken. Naturally, in the event the petitioner remains aggrieved, he will be at liberty to take the appropriate remedies. 4.
Mr. Hitesh Vali, learned Additional Public Prosecutor for the State, states that the Investigating Officer in the matter has already been changed, and prayer (c) of the petition therefore does not survive. 5.
The petition, alongwith pending applications, is disposed of in terms of the aforesaid submission.

It is made clear that notice has not been served upon the accused [respondent No. 2 to 4], and the observations herein are not intended to adjudicate the veracity of any allegation made by the petitioner. This order is also without prejudice to the rights and contentions of the accused.
