Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Applicant / Petitioner for release of the Petitioner for renewal of Visa and to visit the Petitioner's daughter in USA. 4.

Learned APP for the State appears on advance Notice. 5.

Learned counsel for the Petitioner submits that Supreme Court in SLP (CRL.) No.2280/2025 titled as Ravinder Pratap Singh vs. State NCT of Delhi, has directed that the Applicant shall deposit his original Passport before the learned Trial Court and in compliance therefore, the Applicant had deposited his Passport.

It is submitted that his Visa for USA has expired in November, 2025 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 10/12/2025 at 12:19:01

and he intends to travel to USA to meet his daughter and therefore, his Passport may be released to him to facilitate his travel to USA by renewing his VISA.

Learned MM dismissed his Application vide Order dated 14.07.2025. Submissions heard and record perused.

While Hon'ble Apex Court vide Order dated 24.03.2025 has directed the Petitioner to surrender his Passport, but present Application is only for the purpose of getting the Passport released for renewal of his VISA. It does not imply that it is for return of Passport. Therefore, Applicant's Passport be released to him for eight weeks for renewal of his VISA for USA, with directions that he shall surrender his Passport before the learned Trial Court. 9.

It is hereby clarified that mere stamping of VISA for USA, is in no way granting permission to the Applicant to travel to USA, for which, he may move a separate Application before the learned MM. 10.

Accordingly, the petition is disposed of.
