% 27.04.2026 CRL.M.A. 12596/2026 (for early hearing) By way of the present application, the petitioner seeks early hearing of the captioned petition.
For the reasons stated therein, and with the consent of Mr. Hitesh Vali, learned Additional Public Prosecutor for the State, the application is allowed and the petition is taken up on Board. The application stands disposed of.

By way of the present petition, filed in December 2025, the petitioners, who are the parents-in-law of respondent No. 2, assail the order dated 28.10.2024 passed by the learned Judicial Magistrate First Class-02, Mahila Courts, South West, Dwarka, New Delhi, whereby summons were issued in proceedings arising out of FIR No. 95/2024 dated 09.03.2024, registered under Sections 498A/406/34 of the Indian Penal Code, 1860, at the instance of respondent No. 2. After some arguments, Mr. Ashim Shridhar, learned counsel for the petitioners, seeks permission to withdraw the present petition, without prejudice to the petitioners' right to avail appropriate revisional remedies before the learned Sessions Court.

The petition is accordingly dismissed as withdrawn in terms of the aforesaid submission.

It is clarified that no notice was issued in the present petition and that respondent No. 2 is not represented; accordingly, the learned revisional Court may consider the matter on all aspects, including the issue of delay, in accordance with law.

Mr. Shridhar further seeks to reserve the right of the petitioners to seek exemption from personal appearance before the learned Trial Court. If the petitioners move an appropriate application in this regard before the learned Trial Court, it may be considered, in accordance with law. 6.
It is made clear that this Court has not expressed any opinion on the merits of the case, and all rights and contentions of the parties are kept open.

The next date of hearing already fixed, i.e. 22.07.2026, stands cancelled.
