O R D E R

The present writ petition has been filed seeking setting aside of the Demolition Order dated 11th November, 2025, passed by the Municipal Corporation of Delhi ("MCD") in respect of the property bearing House No. 108, Near Electric Pole No. 511-64/6, Village Hiranki, Delhi-110036. 2.

Learned counsel appearing for the petitioner submits that an appeal bearing Appeal No. 798/2025 against the aforesaid Demolition Order has been filed by the petitioner before the Appellate Tribunal MCD th November, 2025. He submits that notices have been ("ATMCD") on 24 issued in the said appeal.

He further submits that an early hearing application was also filed, wherein, and notice has been issued and the matter is now fixed before the ATMCD on 12th February, 2026.

Learned counsel appearing for the petitioner further submits that an th application for regularization has also been filed before the MCD on 18 November, 2025.

Thus, it is submitted that interim protection be granted in favour of the petitioner.

Issue notice. Notice is accepted by learned counsel appearing for the respondents.

Learned counsel appearing for the respondent-MCD confirms the fact that regularization application of the petitioner is pending before the MCD. 8.

After some arguments, learned counsel appearing for the MCD submits that he has instructions to submit that the MCD shall not take action against the property of the petitioner till the next date of hearing before the ATMCD, i.e., 12th February, 2026.

The aforesaid statement is taken note of.

Accordingly, it is directed that the MCD shall not take action against the property of the petitioner, till the next date before the learned ATMCD, i.e., 12th February, 2026, as per its statement as recorded hereinabove. 11.

Needless to state, the petitioner shall not carry out any unauthorized construction in the property in question.

Noting the aforesaid, the present writ petition, along with the pending applications, is accordingly disposed of.
