The petitioner has filed the present petition under Section 11 of the Arbitration and Conciliation Act, 1996, inter alia, praying that an arbitrator be appointed to adjudicate the disputes that have arisen in connection with the Allotment letter and Addendum to allotment letter dated 12.07.2017. 2.

The petitioner invoked the arbitration clause by a letter dated 28.12.2016 and also named the Sole Arbitrator. The same was not acceptable to the respondent and the respondent named another person to act as a Sole Arbitrator.

The learned counsel for the parties state that although the arbitration clause contemplates appointment of an arbitral tribunal of three members, the parties are agreeable that a sole arbitrator be appointed.

With the consent of the parties, it is directed that a Sole Arbitrator be appointed under the Rules of Delhi International Arbitration Centre (DIAC). The parties shall appear before the Co-ordinator, DIAC on 16.05.2017 at 11:00 AM. The arbitration shall be conducted under the aegis of DIAC and in accordance with its Rules.

The petition is disposed of.
