The present application has been filed under Section 482 of the Bhartiya Nagharik Suraksha Sanhita, 2023 (hereinafter 'BNSS') on behalf of the applicant seeking grant of anticipatory bail in case arising from FIR No. 38/2022 dated 30.01.2022, registered at Police Station I.G.I. Airport, Delhi for offences under Sections 419/420/468/471/120B of the Indian Penal Code, 1860 (IPC) and Section 12 of the Passports Act, 1967. 2.

The FIR in this case was registered on receipt of a complaint regarding making of fake and forged passport and facilitating illegal immigration.

The learned counsel appearing for the applicant argues that the applicant has been falsely implicated in the present case. He submits that the complainant had not made allegation against the applicant. He submits that the applicant is a resident of Italy and is cooperating with investigation. states that the applicant has joined investigation. He argues that the other coaccused persons have already been granted bail. 4.

The learned APP for the State on instructions from the IO submits that the petitioner has joined investigation pursuant to order passed by this Court on 24.12.2024 and is co-operating with investigating agency. He also submits that his custodial interrogation is not required. 5.

This Court notes that the applicant has been cooperating with the investigating agency. As submitted by the learned APP for the State on instructions from the IO, who is present before the Court that the accused has joined investigation, has been co-operating with the investigating agency and his custodial interrogation is not required, it is directed that in the event of arrest, the applicant shall be released on bail, subject to furnishing a personal bond in the sum of Rs.10,000/- with one surety of the like amount to the satisfaction of the IO/SHO concerned, on the following conditions: i) The applicant shall remain available on mobile numbers; shared by him with the I.O./S.H.O.

ii) The applicant shall not leave NCT of Delhi without prior permission of the learned Court concerned.

iii) The applicant shall join investigation as and when asked by the I.O./S.H.O.
