By virtue of the present application under Section 483 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [erstwhile Section 439 of the Code of Criminal Procedure, 1973], the applicant seeks grant of regular bail in case arising out of FIR No. 100/2020, registered at PS.: Bawana, Delhi, under Section 307 of the Indian Penal Code, 1860 (IPC) and Sections 25/27 of the Arms Act, 1959. 2.

A perusal of the record reveals that, admittedly, the last bail application of the applicant herein was dismissed by the learned Trial Court on 01.12.2025 vide a detailed and well-reasoned order after considering all the facts and circumstances as also the grounds raised therein, and after hearing learned counsel for the applicant therein. application on 03.12.2025 before this Court, but on the very same set of facts, circumstances and grounds raised, which have already been negated by the learned Trial Court. Further, there are no new/ different pleadings reflecting any change in circumstances.

Thus, considering the element of newness is missing in the present application, as also the learned Trial Court, being a competent Court of law, has duly rendered its findings on merits upon the existing facts and circumstances as on that date/ time/ period, there are/ is no reasons for this Court to hear the application all over again on the very same set of facts, circumstances and grounds.
