BAIL APPLN. 4840/2024 By way of the present petition filed under section 482 of the Bharatiya Nagarik Suraksha Sanhita 2023 ('BNSS'), the petitioner seeks anticipatory bail in case FIR No. RC0062023A0032 dated 31.12.2023 registered under section 13(2) read with section 13(1)(e) of the Prevention of Corruption Act, 1988 and section 109 of the Indian Penal Code, 1860 at P.S.: ACB Lucknow, Uttar Pradesh.

On a plain reading of section 482 read with section 2(j) of the BNSS, it is seen that this court has no territorial jurisdiction in the matter. Furthermore, it is also observed that the petitioner has not availed his remedy available before the Sessions Court of competent territorial jurisdiction.

The petition is accordingly dismissed for lack of territorial jurisdiction without making any observations on the merits of the case. The petitioner shall be at liberty to file for appropriate relief before the court of competent jurisdiction.
