Petitioner had been defending a recovery suit and was aggrieved by order dated 22.10.2024 whereby his one application moved under Section 214 of the Indian Succession Act, 1925 was dismissed. 2.
Learned counsel for petitioner, however, submits that present petition has now become infructuous as the suit in question has already been withdrawn by the concerned plaintiff in terms of the amicable settlement. He further submits that present petition may, accordingly, be disposed of. 3.
In view of the aforesaid development and since the matter has been amicably settled between the parties and the suit has already been withdrawn, the present petition is disposed of as having become infructuous.
