Petitioner/counter-claimant has assailed orders dated 10.10.2025 and 29.10.2025 of the learned Sole Arbitrator, whereby cost imposed for delayed filing of statement of defence was not completely waived off and the delay in filing rejoinder was ignored, which according to the petitioner would prima facie reflect arbitrariness.

After addressing partly, learned counsel for petitioner on instructions seeks permission to withdraw this petition with liberty to institute appropriate proceedings at appropriate stage. 3.

Accordingly, the petition is dismissed as withdrawn with liberty as sought.
