Petitioner/judgement debtor has assailed order dated 17.10.2025 passed by the execution court, whereby application of the respondent/decree holder for setting aside mediation settlement dated 03.02.2025 was allowed, holding the settlement to be completely unfair. 2.

It appears that as against the claim of amount above Rs. 21,00,000/-, the mediator settled it at Rs. 5,00,000/-.

After addressing partly, learned counsel for petitioner on instructions seeks permission to withdraw this petition with liberty to file fresh application before the learned execution court in terms with paragraph 12 of the impugned order. It is clarified by learned counsel for petitioner that the petitioner is aggrieved only to the extent of paragraph 12 of the impugned order.
