Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner for setting aside Summoning Order dated 06.10.2025 passed by learned MM in CR Case No.1581/2023, arising out of FIR No.0391/2022.

Learned counsel for the Petitioner submits that though revision was preferred before the learned ASJ and it has been noted that the learned Trial Court and Revisional Court are reluctant to grant any relief to the Petitioner, however, he seeks permission to withdraw present Petition with liberty to approach the learned Court of Sessions.
