This is a petition filed under section 528 of BNSS read with Article 227 of the Constitution of India seeking directions to be issued to the learned Judicial Magistrate (North) Rohini Courts, Delhi for time bound and expeditious disposal of complaint cases bearing Nos.
12948/2016, 1047/2017 and 1557/2017 titled 'Narender Bhutani v. M/s. Ultra Homes Cons. Pvt. Ltd & Ors.'.

It is stated by Ms Sharma, learned counsel for the petitioner that the complaints under Section 138 of the Negotiable Instruments Act, 1881 filed by the petitioner are of the year 2016 and the matters are still at the stage of The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. framing of notice under Section 251 CrPC.

A perusal of the order sheet reveals that the complaint cases were frequently adjourned because the respondents, being in jail, could not appear, and the learned Metropolitan Magistrate was awaiting their production.

Ms Sharma, learned counsel states that all the respondents are now on bail. She further states that pursuant to the directions of Hon'ble Supreme Court in SUO MOTU WRIT (CRIMINAL) NO. 2 OF 2020, this court has time and again issued directions to the Judicial Officers to ensure that complaint cases under section 138 of the Negotiable Instruments Act, 1881 which are pending for more than 5 years must be disposed of expeditiously. 7.
Since the petitioner at this stage only seeks expeditious disposal of the criminal complaints pending before the Rohini Courts, Delhi, I am not inclined to issue notice to the respondents.

Since the complaint cases are pending for more than 7 years, the learned Metropolitan Magistrate is requested to ensure expeditious disposal of the above said complaint cases.
