The application stands disposed of.

CRL.M.C. 10230/2024 1.

This is a petition seeking quashing of FIR No. 0346/2017 dated 02.09.2017 u/s 354/354D/506/509 IPC registered at PS Ashok Vihar. 2.

As per the FIR, there are allegations that the petitioner misbehaved and the petitioner was in an inebriated state. 3.

During the pendency of the proceedings, parties have arrived at a settlement dated 11.12.2024, wherein the respondent No. 2 has given an NOC in which she has agreed to cooperate in quashing of the FIR. 4.

Petitioner is present in Court and is identified by Mr. Sonu Jha, Adv. Respondent No. 2 is also present through VC and is identified by Mr. Sonu Jha, Adv. and IO Monika Rawat, PS Ashok Vihar. 5.

free will without any threat, pressure, coercion or undue influence. 6.

I am of the opinion that no useful purpose would be served in prosecuting the FIR any further on the ground that the parties have arrived at a voluntary settlement and settled their disputes. 7.

I am of the view that since the matter is settled, there is very little chance of respondent No. 2 coming forward and deposing as a witness and hence the proceedings will be a waste of judicial time. 8.

I am convinced that quashing of such proceedings on account of compromise would bring about peace and would secure ends of justice. The Court does not see any fruitful purpose if criminal proceedings as permitted to continue any further. It is a fit case for quashing. In this view of the matter, there is no reason to continue the proceedings. However, in my considered opinion, considerable judicial time has been wasted. The police machinery has been put in motion on account of the acts of commission & omission on behalf of the parties and useful time of the police which could have been utilised for important matters has been misdirected towards this case. Hence, the petitioner must pay costs. 9.

The petitioner shall deposit Rs. 10,000/- as costs with DHCLSC within 4 weeks from today and the proof of cost will be filed with the Registry within 6 weeks from today.

Subject to the above, FIR No. 0346/2017 dated 02.09.2017 u/s 354/354D/506/509 IPC registered at PS Ashok Vihar is hereby quashed. 11.

The petition is disposed of.
