This hearing has been done through hybrid mode. 2.
The present petition under Section 25-B (8) of the Delhi Rent Control, 1958 seeks the following prayers: - "i) allow the present Petition filed by the Petitioner thereby setting aside the Impugned Judgment dated 12.09.2024 passed by Court of Ms. Arjinder Kaur, Learned ARC, Central District, Tis Hazari Courts, Delhi, in eviction Petition bearing RC ARC No. 862/2023 titled "Parveen Gupta vs. M/s S.N Kohli & Sons" and pass an order granting leave to contest/ defend the eviction Petition in favour of the Petitioner herein and against the Respondent, pertaining to shop bearing No. 1901- A, Chandni Chowk, Delhi- 110006; and/or ii) Any other relief / order as this Hon'ble Court deems fit and proper in favour of the Petitioner."

On 23.03.2026, this Court had passed the following order: - "2. Learned counsel appearing on behalf of the parties submit that the latter have arrived at a settlement, and in pursuance of the same the petitioner had agreed to vacate the subject property on or before 31.10.2026, and the respondent had agreed to waive off the user and occupation charges. Let an affidavit of undertaking, with respect to the aforesaid, be placed on record before the next date of hearing.
3. List on 07.04.2026."

Affidavit in terms of the aforesaid order has been placed on record wherein it has been recorded as under: - "2. That the present Affidavit cum Undertaking is being filed on behalf of the Petitioner in light of the Order dated 23.03.2026 passed by this Hon'ble Court in the present matter. A copy of the Order dated 23.03.2026 passed by this Hon'ble Court is annexed herewith as Annexure-A.
3. That the Petitioner herein is a tenant in possession of shop bearing No. 1901-A, Chandni Chowk, Delhi- 110006 (hereinafter referred to as the tenanted premises).
4. That during the pendency of the present matter, the parties have arrived at a settlement and in pursuance of the same the Petitioner has agreed to vacate the tenanted premises on or before 31.10.2026, and the Respondent has agreed to waive off the user and occupation charges. The Respondent has further agreed to withdraw the execution petition bearing no. 632/2025 pending before Ld. Additional Rent Controller, Tis Hazari Courts.
5. That accordingly, the Petitioner undertakes to handover the vacant, physical and peaceful possession of the tenanted premises to the Respondent on or before 31.10.2026."

In view of the above, learned counsel appearing on behalf of the petitioner seeks leave to withdraw the present petition. 6.
