The Petitioner, a law graduate, has applied for enrolment as an Advocate before the Bar Council of Uttarakhand. The said request was rejected by the Enrollment Committee of Bar Council of Uttarakhand through orders dated 20th August, 2022 and 30th March, 2024 on the ground that he has several criminal cases registered against him. Subsequently, a reference under Section 26 of the Advocates Act, 1961 was made to the Bar Council of India.

According to the Petitioner, the reference is pending consideration with Bar Council of India since May, 2024 and since substantial time has lapsed, they have approached this Court seeking the following reliefs:

"a. To issue writ of mandamus or any other appropriate writ or direction in the like nature directing the respondent to consider and decide the pending reference of the petitioner referred by the Bar Council of Uttarakhand in Case No. BCUK/43/2024; and b. deem fit and proper in the circumstances of the case and render justice." 2.

Mr. Preetpal Singh, counsel representing for Bar Council of India, at the outset, states that he has received instructions to inform the Court that the reference shall be decided expeditiously. His statement is taken on record.

In light of the foregoing, the present writ petition is disposed of with a direction to decide the reference expeditiously, preferably within a period of three months from today.

All rights and contentions of the parties are left open. 5.

Disposed of.
