O R D E R

% 31.07.2018 The petition at hand itself indicates that the petitioner knowing fully well about the proceedings against him refuses to surrender to the jurisdiction of the courts in India, his attempt to challenge the order declaring him proclaimed offender having been questioned through an attorney.

The prime ground on which the order of the Magistrate declaring him an absconder is that the proclamation under Section 82 Cr.P.C. was published at a place where he was not residing. The proceedings on record reveal that the proclamation under Section 82 Cr.P.C. was published at the last known address of the petitioner in India, it having later come to light that he had absconded from India, he statedly being now in Scotland, U.K. There is no error or impropriety in the impugned order. It is inherent in the petition that the petitioner knowing fully well of the court process has CRL.M.C. 1721/2018

successfully evaded it all these years. This court, thus, is not inclined to interfere under Section 482 Cr.P.C.

Dismissed.

Pending application also stands disposed of.
