It is submitted on behalf of petitioners that advance notice of this application was served on counsel for respondents. In view of circumstances mentioned hereafter, learned senior counsel on instructions of briefing counsel seeks permission to withdraw this application. The application is dismissed as withdrawn. On last date, the matter was taken up before this bench for the first time and was adjourned to 26.08.2025 at request of counsel for petitioners. On last date, learned counsel for respondent no. 1 pointed out that the present petition is not even maintainable.

In the course of submissions today, learned briefing counsel disclosed that for the same relief as sought in this writ petition, an application has already been moved before the learned trial court by the trial court counsel. Learned senior counsel submits that he was not aware about the said filing. 5.

Under these circumstances, learned senior counsel for petitioner on instructions of the briefing counsel seeks permission to withdraw this writ petition with liberty to pursue the application pending before the trial magistrate.

Accordingly, the date of 26.08.2025 is cancelled. The writ petition is dismissed as withdrawn with liberty as sought.
