This is a writ petition seeking the following substantial prayers: "A. Grant parole for a period of 4 weeks in FIR No. 421/1984 u/s 302/396/395/449/436/147/149 IPC, P.S. Delhi Cantt, New Delhi; B. Extend the parole granted to the petitioner vide Order dated 29.11.2024 for a period of 4 weeks in FIR No.421/1984 u/s 302/396/395/449/436/147/149 IPC, P.S. Delhi Cantt, New Delhi; ...."

Though the petition is nomenclatured as grant of parole for 4 weeks, it is actually a petition seeking extension of parole already granted to the petitioner vide order dated 29.11.2024.

It is stated that the wife of the petitioner is an old lady and is to undergo cataract surgery, hence the petition. Issue notice. Ms. Aggarwal, learned counsel appears and states that in the present case, there is no date of surgery mentioned in the petition and the same is open ended.

She further states that the same will be exploited to extend the parole indefinitely.

I am of the view that in the present case, 05.12.2024 was the date for performing of the surgery, which could not be performed as the wife of the petitioner was suffering from high sugar. Once the sugar levels are under control, the surgery will be performed.

For the said reasons, the parole granted to the petitioner on 29.11.2024 is extended by a period of 10 days to ensure that the cataract surgery of the wife is performed.

The terms and conditions of the order dated 29.11.2024 shall apply and after expiry of the period of 10 days from today, the petitioner shall surrender.

The petition is disposed of accordingly.
