% 25.07.2018 By this petition the petitioner had sought parole on the ground of maintaining social ties and filing of Special Leave Petition. Notice in this petition was issued to the State on 9th April, 2018, returnable for today. On 8th June, 2018, the petitioner informed that his wife was to undergo surgery and thus parole for a period of 7 days was granted to the petitioner vide order dated 8th June, 2018. On 22nd June, 2018 the petitioner came up with an application seeking extension of parole on the ground that the surgery of his wife has been re-scheduled for 28th June, 2018. Since the parole of the petitioner was expiring on 22nd June, 2018 as he was released from jail on 14th June, 2018, this Court extended the parole of the petitioner for another W.P.(CRL) 993/2018
two weeks and disposed of the application.
Thereafter, petitioner filed another application seeking extension of parole on the ground that the surgery of his wife was re-scheduled for 13th July, 2018 which application was dismissed by this Court on 5th July, 2018 on the ground that when the surgery was not performed, the petitioner ought to have surrendered and the petitioner cannot avail the parole and then say that surgery was re-scheduled. A perusal of the orders as noted above reveal that the petitioner has already availed parole for a period of three weeks. In those three weeks, surgery of the petitioner's wife was not performed. Thus, the petitioner could have availed the said period for filing the SLP. This Court finds no ground to grant any further parole to the petitioner at this stage. Petition is dismissed.
