By way of the present application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [corresponding to Section 439 of the Code of Criminal Procedure, 1973], the applicant seeks the grant of regular bail in connection with FIR No. 821/2015 dated 08.10.2015, registered at P.S. Dwarka North (South West), New Delhi, under Section 302 of the Indian Penal Code, 1860 and Sections 25/27/54/59 of the Arms Act, 1959.

Mr. Yudhvir Singh Chauhan, learned Additional Public Prosecutor, states that 6 out of 27 witnesses have been examined, and 1 public witness is yet to be examined. The said witness has been summoned for 23.03.2026.

In view of the aforesaid position, Mr. Vipin Sehrawat, learned counsel for the applicant, seeks permission to withdraw the present bail BAIL APPLN. 4760/2025 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. application, without prejudice to the applicant's right to move the learned Sessions Court after the recording of the evidence of the material witnesses. He further submits that, having regard to the length of incarceration of the applicant, the learned Sessions Court may be requested to expedite the trial.

The applicant is accordingly at liberty to move the learned Sessions Court for expeditious trial, having regard to the fact that he has already been in custody for a considerable period. In the event such a request is made, the learned Sessions Court may consider the same in accordance with its own Board, and the age of matters pending before it. Mr. Chauhan submits that the prosecution will cooperate in the expeditious disposal of the proceedings.

The bail application, alongwith the pending application, is accordingly dismissed as withdrawn, with liberty as aforesaid.
