This revision petition is directed against an order dated 05.06.2024, passed by the District Judge-05, South West District, Dwarka Courts, New Delhi, in CS DJ ADJ No. 315/2021, by which the Trial Court allowed the petitioner's [defendant in the suit] leave to defend application under Order 37 of the Code of Civil Procedure, 1908 ["CPC"], but with a condition to deposit 50% of the suit amount.

Mr. Sanjeev Sehgal, learned counsel for the petitioner, seeks permission to withdraw this revision petition in view of the proviso to Section 115(1) of the CPC, with liberty to file appropriate proceedings against the impugned order.

The petition, alongwith pending applications, is dismissed as withdrawn, with liberty as aforesaid.
