This hearing has been done through hybrid mode. 2.
The present petition under Articles 226/227 of the Constitution of India seeks the following prayers:
"(i) Issue a writ of mandamus or any other appropriate writ, order or direction directing Respondent Nos. 1 and 2 to continue to employ the Petitioner-workers and restrain them from effecting any termination of their services, including from Jawaharlal Nehru University, New Delhi and directing them to abide by their statements/assurances recorded before the Assistant Labour Commissioner in the conciliation proceedings dated 21.11.2025; (ii) Direct Respondent Nos. 1 and 2 to maintain status quo with respect to the service conditions of the Petitioners and not to terminate their services without strict compliance with Section 33 of the Industrial Disputes Act, 1947;
(iii) Issue a writ, order or direction restraining Respondent Nos. 1 and 2 from replacing the Petitioners with any other set of contract workers and from demanding commissions from the workers for their continuation.
(iv) Issue an appropriate writ, order or direction directing the transfer of the pending Industrial Dispute referenced on 24.01.2025 from CGIT-I to CGIT-II or any other competent Tribunal, in view The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. of the absence of a Presiding Officer in CGIT-I for over a year, so as to ensure expeditious adjudication of the dispute. (v) Pass such further order(s) and/or direction(s) as this Hon'ble Court may deem fit and proper in the interest of justice in favour of the Petitioner."

Learned counsel for the petitioner submits that she is only restricting the present petition to prayer "iv."

Learned counsel for respondent nos. 3, on advance notice, has handed up a notification dated 11th July, 2025 published by Government of India, Ministry of Labour and Employment, which records as under: "No. A-11016/05/2021-CLS-II(E): The president is pleased to extend the additional charge of the post of Presiding Officer, Central Government Industrial-cum-Labour Court, Delhi-I entrusted to Shri Atul Kumar Garg, Presiding Officer, Central Government Industrial Tribunal-cum-Labour Court, Delhi-II for a further period of six months with effect from 30.06.2025 or till the post is filled up on regular basis, or until further orders, whichever is the earliest."

In view of the above, the present petition is disposed of with the direction that the industrial dispute of the petitioner may be referred to CGITII in terms of the aforesaid notification. 6.
No further directions are called for.
