Petitioners are defending a suit seeking recovery and are aggrieved by order passed on the basis of the application moved by the plaintiff under Order XXXVIII Rule 5 CPC.

However, learned counsel for petitioners/defendants submits that the matter has already been amicably settled between the parties and pursuant to such settlement, even the suit in question has been withdrawn by the respondent.

He submits that, in view of the above, the present petition has rather become infructuous.

In view of the above statement made by the learned counsel for petitioners, the present petition is disposed of as having become infructuous.
