Mr. Farman Ali, learned CGSC fairly submits that in view of the decision passed by this Court, relying upon the decision of the Supreme Court, mere pendency of the FIR should not be an impediment in the issuance or renewal of the passport. He, however, contends that if the charge sheet is filed, the petitioner will have to obtain the permission from the concerned Court.

With the aforesaid submissions being placed on record, the petitioner is permitted to apply afresh and the same shall be considered in accordance with law.
