This writ petition is filed on behalf of the Petitioner under Article 226 of the Constitution of India seeking the following reliefs:- "(a) To issue an appropriate writ in the nature of mandamus, order or directions to the Respondents to permit the Petitioner to join MBBS Seat allotted to her in Stray Vacancy Round of NEET (UG) 2025 at Yenepoya Medical College, Mangalore by condoning the delay in joining. (b) In the alternative, direct the Respondents to allot the Petitioner the same MBBS Seat by creating a supernumerary seat, if required, in the interest of justice.

(c)Direct the Respondents to extend reasonable time for the Petitioner to complete joining formalities."

Issue notice.

Ms. Avshreya Pratap Singh Rudy, learned Central Government Standing Counsel accepts notice on behalf of the Respondents and on instructions submits that Petitioner has been allotted Yenepoya Medical College, Mangalore in the Stray Vacancy Round of NEET UG, 2025 and after examining the facts and circumstances of the case as also considering that a seat was available, it has been decided to offer her the seat, without treating this case as a precedent. In support of this submission, she hands over copy of communication dated 09.12.2025 from Director General of Health Services in this regard. Copy of the letter is taken on record. 6.

In light of this, learned counsel for the Petitioner seeks to withdraw the petition as the grievance ventilated stands redressed. Petitioner undertakes to join the allotted College within 7 days from today. 7.

Court appreciates the fair stand taken by the Respondents in the peculiar facts of this case. It is, however, made clear that neither the stand taken by the Respondents nor this order will be treated as a precedent for any other case.
