This petition has been filed by the petitioner praying for the following reliefs:

"A. Issuance of a writ in the nature of mandamus or any such order by directing the Respondent No. 2 to 5 for calling the basic pay fixation record of the Petitioner Inspector/GD Sh. Sourav Kumar Force No. 065150244 from the joining to till date in order to rectify the basic pay scale of the petitioner in interest of justice;

B. To issue a writ of mandamus or any such order by directing the Respondent No. 2 to 5 to fix/correct the basic pay scale of the Petitioner alike to the juniors/similarly placed personnel; along with subsequent benefits arising there from;

C. To issue a writ of mandamus or any such order by directing the respondent No. 2 to 5 to give the arrears to the petitioner after refixation of his basic pay scale and all subsequent benefits arising there from;"

post of Inspector/GD on 29.06.2016. He came to know that his batchmates, who were promoted by way of the same notification, were receiving a higher basic pay than him.

The learned counsel for the petitioner places reliance on the Judgments of this Court in Vijayan V.V. v. Union of India & Ors., 2019:DHC:7797-DB, and Pradeep Kumar v. Union of India & Ors., 2024:DHC:5570-DB, to submit that the petitioner is, therefore, entitled to the re-fixation of his basic pay in parity with what is drawn by his batch-mates.

Keeping in view the nature of the relief claimed, as also having heard the learned counsel for the petitioner, we are of the opinion that the respondents should consider the contents of the present petition, especially keeping in view the above-referred Judgments of this Court, as a representation of the petitioner and decide upon the same within a period of eight weeks from today. In case the petitioner is found entitled to the relief as claimed, a consequential order for the same shall also be passed by the respondents within the said period. 5.

Needless to state, in case the order passed by the respondents is adverse to the interest of the petitioner, it shall be open to the petitioner to challenge the same in accordance with law. 6.

The petition along with the pending application is disposed of with the above directions.
