The present petition has been filed under Section 29A(4) and 29A(5) of the Arbitration and Conciliation Act, 1996 seeking extension of the mandate of the Arbitral Tribunal.

Ms. Madhumita Bhattacharjee, counsel appearing on behalf of the respondent, without prejudice to the contentions of the respondent that the seat of arbitration is Calcutta, does not oppose the present petition. 3.

She further submits that the finding of the arbitrator that the seat of the arbitration is Delhi has been challenged by the respondent before the High Court of Calcutta.

In view of the aforesaid facts, without making any determination with regard to the seat of arbitration, the mandate of the Arbitral Tribunal is extended for a further period of twelve (12) months from today.
