O R D E R

% 09.03.2019 These are the two cross appeals and both the appeals have come to be resolved amicably and under the settlement, the parties have mutually agreed that out of the awarded amount deposited by the Insurance Company on 23.03.2015 along with accrued interest amounting to Rs. 19,73,308/- , Rs. 15,00,000/- along with the proportionate interest accrued on sum of

Rs. 15,00,000/- w.e.f. 24.03.2015 till realisation shall go to the claimants and the balance amount lying deposited shall go to the Insurance Company. The amounts shall be released to the respective parties in terms of the award.

As for the claim of the legal heirs on the demise of the respondent No.4 Sh. Udaybhan Dhar Dube, an appropriate application may be filed by the legal heirs before MACT, who shall decide such application in accordance with law and order release of the amounts to the concerned in accordance with law.

The impugned award stands modified to that effect. Consequently, the appeal shall stand disposed of.

The statutory amount deposited for entertainment of the appeal alongwith interest, if any, shall be refunded to the insurance company (A.K. CHAWLA) PRESIDING OFFICER (K. VENKATRAMAN) CO-MEMBER MARCH 09, 2019 rc
