1. This is a petition seeking for setting aside of the order passed by learned ACJM East District, Karkardooma Court in 46 CR Cases 213/2020, in case titled as "States Vs. Vikas Sharma" and another dated 17.12.2024 arising out of the FIR No. 157/2019, registered at PS Preet Vihar.
2. In the present case, the learned ACJM has directed the petitioner to deposit all the original documents of the property purchased by him from the alleged cheated amount. The properties purchased from the alleged cheated amounts have been mentioned as under: S. No.

3. The Court of learned ASJ, while granting bail and as a condition of bail, has already directed that the petitioner shall not sell, alienate, transfer, mortgage the abovesaid three properties.
The said undertaking has already been filed and is available at page 40.
4. The learned counsel for the petitioner states that the original of these three properties are not available with the petitioner and certified copies have already been filed.
5. The learned counsel for the petitioner further states that the properties have not been mortgaged, alienated or encumbrances created on the said properties. However, the originals of the same are not available with the petitioner.
6. This court, at this stage, would not like to get into the fact finding enquiry as to whether these documents are available with the petitioner or not. The intention of the order of 17.12.2024 is only to ensure that the petitioner should not deal with the properties.
7. The same can be addressed by directing the Sub-Registrar, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
Ghaziabad, UP and Sub-Registrar, Modi Nagar, UP dealing with the jurisdictional area of the said properties to ensure that no transactions are registered as regards the three properties are concerned.
8. Additionally, the petitioner shall also issue publication in open newspaper having circulation in Modi Nagar, Raispur, Ghaziabad, UP, that the originals of the said properties have been misplaced by the petitioner and the same shall be filed before learned ACJM East, Karkardooma Courts within four weeks from today.
9. It is also directed that the petitioner shall not part with the possession of the said properties.
10.Subject to the above, the order of 17.12.2024 is hereby modified. 11.The complainant is at liberty to serve a copy of this order to the concerned Sub-Registrars.
