This is a petition under Section 29A (4) & (5) of the Arbitration & Conciliation Act, 1996 seeking extension of mandate of the Arbitral Tribunal for making the arbitral award.

The learned Arbitrator was appointed pursuant to an application of the petitioner under Section 3G (5) of the National Highways Act, 1956. It is submitted that the pleadings have been completed before the learned Sole Arbitrator and the arbitration is at the stage of arguments. 3.

March, 2024. The Petitioner has, therefore, approached this Court for extension of time for making the award. It is very unfortunate that the mandate of the Tribunal has expired in March, 2024 and the parties have not yet taken any step for extension of the mandate of the Arbitrator. However, in view of the fact that substantial time and money has been spent by the Parties on the Arbitration and the fact that evidence has been completed and the matter is at the stage of final arguments, this Court is inclined to extend the mandate of the Arbitrator from March, 2024 till 10.06.2025 so that the Award can be pronounced and no further extension of time would be required by the Tribunal.

The petition is disposed of along with the pending applications, if any.
