This is a petition under Section 29A (4) & (5) of the Arbitration & Conciliation Act, 1996 seeking extension of mandate of the Arbitral Tribunal for making the arbitral award.

The learned Arbitrator was appointed pursuant to an application of the petitioner under Section 11 of the Arbitration and Conciliation Act, 1996 for the appointment of Arbitrator as per Article 11 of the Concession Agreement dated 31.01.2005. before the learned Sole Arbitrator and the arbitration is at the stage of arguments.

It is stated that the mandate of the Arbitral Tribunal will expire on 24.02.2024. The Petitioner has, therefore, approached this Court for extension of time for making the award.

In view of the fact that the matter is at the stage of stage of final arguments, this Court is inclined to extend the mandate of the Arbitral Tribunal till 31.10.2025 so that the Award can be pronounced and no further extension of time would be required by the Tribunal. 5.

The petition is disposed of along with the pending applications, if any.
